DIICOT points out, after more and more online stores or companies sell hemp products, that any product containing Tetrahydrocannabinol (THC) – a psychotropic substance, biosynthesized by the cannabis plant, regardless of concentration, falls under the notion of risk drug and is subject to criminal provisions.
The statement was made by DIICOT in a statement sent on Tuesday, after prosecutors conducted 23 searches in the counties of Brasov, Timis, Sibiu and Cluj, at the homes of some people accused of selling risky drugs through companies / shops, which promoted products obtained from hemp, claiming to have beneficial effects on health.
According to DIICOT, during 2020, several people carried out risky drug trafficking activities, through companies that sold products containing Tetrahydrocannabinol (THC), a psychotropic substance, biosynthesized by the cannabis plant.
DIICOT states that 9 – Tetrahydrocannabinol (9 – THC) is a psychotropic substance, biosynthesized by the cannabis plant, and cannabis is part of the Table-Annex no. III of Law no. 143/2000 on preventing and combating illicit drug trafficking and consumption, with subsequent amendments and completions, being a risk drug.
What do the authorities say?
Prosecutors point out that during 2020, stores promoting cannabis products containing cannabidiol (CBD), which would be considered beneficial for health, began operating in Romania. In the presentation of these stores, which soon became developed in the online space, the cannabis plant is used as a logo.
While the appearance takes the form of a plant that creates a resemblance to permitted drug stores (for example in some areas of the Netherlands), suppliers promote products that have a maximum concentration of 0.2% THC, which inoculates the idea. that it would be allowed by European law. Currently, in Romania, there is no specific legislation on the marketing of foods containing various components / derivatives of the cannabis sativa plant (seeds, oil, flour), nor minimum / maximum limits allowed or levels of daily consumption that have been established / appropriated for CBD and THC content of foods (including food supplements). The authorized THC content of 0.20% applies to the cannabis plant (cultivated in an authorized manner), not to the resulting finished product. There are also no regulations in the European Union that allow the marketing of THC containing hemp products, regardless of concentration. Consequently, any product that contains THC falls under the notion of risk drug and falls under the criminal provisions “, DIICOT points out.
Following the searches, several food products based on hemp, about 400 grams of cannabis, hallucinogenic mushrooms, 7 ecstasy tablets, as well as the amounts of 7,500 euros and 7,900 lei were seized.
At the DIICOT headquarters – Braşov Territorial Service, 11 people will be taken for questioning.
